WHEREAS, The Hartz Group, Inc. d/b/a Hartz Mt. Ind., Inc., established an escrow account (MUN15.013.1 a/k/a 7150131) with the Town of Kearny on July 18, 2016 posting a cash portion of the Performance Bond as required relative to Site Plan Application #534 in the Town of Kearny at 435 Bergen Avenue, Block 286, Lot 4;

 

WHEREAS, the project has been completed, and no further work or cost is anticipated;

 

WHEREAS, The Hartz Group, Inc. d/b/a Hartz Mt. Ind., Inc. has requested that the cash portion of the Performance Bond be returned (as the Letter of Credit posted in lieu of a Performance Bond was released on August 30, 2017 to JP Morgan Chase Bank, N.A. as requested by the applicant);

 

NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Town of Kearny that the Chief Financial Officer is hereby authorized to return the unused escrow deposit to The Hartz Group, Inc. d/b/a Hartz Mt. Ind., Inc. in the amount of $611,275.75.
