Resolution Authorizing an Agreement with RCM Ceberio LLC to Perform Consulting Services for the Town Related to Valuation of the Keegan Landfill at a Cost Not to Exceed $3,000.

WHEREAS, the Town has the additional need for consulting services related to the valuation of the landfill in the eminent domain action instituted by the New Jersey Sports and Exposition Authority (the "NJSEA Condemnation Case") against the Town; and


WHEREAS, RCM Ceberio LLC has been identified as a consultant that can provide such assistance in the NJSEA Condemnation Case; and


WHEREAS, public bidding is not required because this is a contract below the bid quote threshold; now therefore, be it


RESOLVED, by the Mayor and Council of the Town of Kearny, Hudson County, New Jersey that:


1.              The Town hereby retains without competitive bids RCM Ceberio LLC to perform the consulting services related to the valuation of the Keegan Landfill in the NJSEA Condemnation Case at the rate of $150/hour for a cost not to exceed $3,000.


2.              The Mayor and Town Clerk are hereby authorized to execute an agreement with RCM Ceberio LLC substantially in the form attached hereto.


3.              The agreement with RCM Ceberio LLC shall be made available for public inspection.


4.              The agreement with RCM Ceberio LLC has not been awarded through a fair and open process under N.J.S.A. 19:44A-20.5 and RCM Ceberio LLC has completed and submitted a business entity disclosure certification which certifies that RCM Ceberio LLC has not made any reportable contributions to a political party committee or candidate committee of any person serving in an elective public office in the Town of Kearny in the previous one year period. The contract shall prohibit RCM Ceberio LLC from making any such reportable contribution through the term of the contract.


6.              A notice of this action shall be printed once in the Jersey Journal.
