Furtherance of the Construction of a Stormwater Pump Station (Block 252, Lot 2.021).

              WHEREAS, as part of the drainage improvements to be made in the Dukes Street, Tappan Street, Devon Terrace and Hoyt Street area, the Town will be constructing a pump station and related stormwater piping on property (Block 252, Lot 1) owned by the Hindu Community Center, Inc. pursuant to an easement previously approved by the Town and the Hindu Community Center; and

 

WHEREAS, in order to transmit stormwater from the pump station to the stormwater line in Bergen Avenue, the Town requires an easement through the property known as Block 252, Lot 2.021 owned by Schuyler Crossing Urban Renewal LLC, an affiliate of Russo Development (“Schuyler Crossing”); and

 

              WHEREAS, Schuyler Crossing has agreed to grant an easement to the Town for this purpose as an in-kind contribution for drainage improvements valued at $35,000, which will be offset against its previously agreed upon cash contribution for drainage improvements; and

 

              WHEREAS, representatives of the Town and Schuyler Crossing Urban Renewal LLC have negotiated all the terms of the easement, now, therefore, be it

 

              RESOLVED by the Mayor and Council of the Town of Kearny, Hudson County, New Jersey that:

 

1.              The Easement Agreement between the Town and Schuyler Crossing Urban Renewal LLC is hereby approved in the form attached hereto.

 

2.              The Mayor or Town Administrator is authorized and directed to execute it on behalf of the Town.

 

3.              The Mayor and/or Town Administrator is hereby authorized to take any other action in furtherance of this Resolution.
