Resolution Authorizing Professional Services Agreement with James S. McNeight, PC at a Cost not to Exceed $3,000 to Provide Architectural Services Needed so that the Town May Proceed against Abandoned Properties Pursuant to the Abandoned Properties and Rehabilitation Act.

              WHEREAS, by enactment of Ordinance 2016-53 (Code Section 17-9.1 et seq.), the Town adopted the “Abandoned Properties and Rehabilitation Act” (the Act), N.J.S.A. 55:19-78 et seq., its provisions, procedures, authority and lawful remedies, empowering the Town and its officials to act under the authority of that Act; and


              WHEREAS, pursuant to the Act and the Ordinance, the Public Officer appointed by the Mayor and Council has determined that various properties in the Town to be Abandoned Properties and placed them on an Abandoned Properties List; and


              WHEREAS, N.J.S.A. 55:19-56 provides that the “clearance, development, redevelopment, or repair of property being maintained as an abandoned property * * * shall be a public purpose and public use for which the power of eminent domain may be exercised.” and


              WHEREAS, proceeding in that manner creates the need for professional reports on the cost to either rehabilitate and reuse the property or to demolish the existing property and construct a new building; and


              WHEREAS, James S. McNeight, PC has submitted a proposal to provide these architectural services; and


              WHEREAS, public bidding is not required because this is a professional service which will be performed by persons and entities licensed under New Jersey law, now, therefore, be it


              RESOLVED by the Mayor and Council of the Town of Kearny, Hudson County, New Jersey that:


              1. The Town hereby retains James S. McNeight, PC without competitive bidding to perform the architectural services set forth in recitals above at an hourly rate not to exceed $200/hour at a cost not to exceed $3,000.00.


              2. The Mayor and Town Clerk are hereby authorized and directed to execute any and all documents and to take any and all actions necessary to complete and realize the intent and purpose of this Resolution.


              3. The agreement with the James S. McNeight, PC has not been awarded through a fair and open process under N.J.S.A. 19:44A-20.5 and that he shall complete and submit a business entity disclosure certification which certifies he has not made any reportable contributions to a political party committee or candidate committee of any person serving in an elective public office in the Town of Kearny in the previous one year period.  He shall be prohibited from making any such reportable contribution through the term of the contract.


              4. A notice of this action shall be printed in the Jersey Journal.
