Resolution Authorizing the Sale at Public Auction of One (1) Abandoned And
Unclaimed Vehicle: 2010 HONDA VIN#5J6RE4H73AL008041

WHEREAS, there is warehoused on the premises of a tower(s) licensed by the Town of Kearny an abandoned and unclaimed motor vehicle(s), now, therefore, be it

RESOLVED by the Mayor and Council of the Town of Kearny, Hudson County, New Jersey, that:

1.              The Town Clerk be and hereby is authorized to conduct an auction for the sale of the following abandoned and unclaimed motor vehicle(s):


                                          2010              HONDA              VIN#5J6RE4H73AL008041


              2.              The public auction shall be conducted in accordance with procedures to be announced by the Town Clerk.

              3.              The Town Clerk shall advertise the sale in the Jersey Journal and on the Kearny website.

              4.              Each vehicle shall be offered for sale in its “as is” condition without any warranties.

              5.              The Police Department shall see to it that any prospective purchaser who requests an inspection shall be given an opportunity to inspect a vehicle, both inside and outside, during regular business hours before the auction.  Any party which is warehousing the vehicle who fails to allow such an inspection upon request shall thereby forfeit its right and license to tow vehicles in the Town of Kearny and shall forfeit any lien it may have by reason of its having warehoused the vehicle.

6.              Each vehicle sold shall be sold subject to existing liens or encumbrances.

              7.              Upon the close of bidding, the highest qualified bidder, as designated by the Town Clerk, shall submit cash or a certified check in the amount of the bid to the Clerk or his bid shall be rejected.

              8.              The Town reserves the right to reject all bids and notice of such reservation shall be included in the advertisement of the auction and publicly announced at the time of the sale.

              9.              All prospective purchasers are put on notice that no employee, agent, officer, body or subordinate body has any authority to waive, modify or amend any of the conditions of sale.
