Ordinance Amending Sections 4-2.1 and 4-2A-1 of the Town Code Pertaining to Drug-Free Zones Around
Schools and Public Properties, by the Approval of Updated Drug-Free Zone Maps

Body

              WHEREAS, the Town previously established by Ordinance Drug-Free Zones around Schools and Public Properties, and adopted maps describing the zones, which maps were intended to be periodically updated; and

 

WHEREAS, the purpose of this Ordinance is to approve and adopt updated Drug-Free Zone maps; now, therefore, be it

 

ORDAINED by the Mayor and Council of the Town of Kearny, Hudson County, New Jersey that:

 

              1.  Section 4-2.1 of the Town Code, entitled Drug-Free School Zone Map, be amended and revised to read as follows:

 

                            4-2.1 Drug-Free School Zone Map Adopted

 

                            Pursuant to N.J.S.A. 2C:35-7, the drug-free school zone map dated February 28, 2019, prepared by Michael Neglia, PE, PLS, PP, the Municipal Engineer, is hereby approved and adopted as an official finding and record of the locations and areas within the Town of property which is used for school purposes and which is owned by or leased to any elementary or secondary school or school board, and of the areas within 1,000 feet of such school property.

 

              2. The Town Clerk be and hereby is directed to comply with the provisions Section 4-2.4.

 

              3. Section 4-2A.1 of the Town Code, entitled Drug-Free Public Property Zone Map, be amended and revised to read as follows:

 

                            4-2A.1 Drug-Free Public Property Zone Map Adopted

 

                            Pursuant to N.J.S.A. 2C:35-7, the drug-free public property zone map dated February 28, 2019, prepared by Michael Neglia, PE, PLS, PP, the Municipal Engineer, is hereby approved and adopted as an official finding and record of the locations and areas within the Town of property which is used for a public housing facility owned by or leased to a housing authority or that is used for any public park, or public building, and of the areas on or within 500 feet of such public housing, public park, or public building property.

 

              4. The Town Clerk be and hereby is directed to comply with the provisions of

Section 4-2A.4.
