Resolution Confirming the Authorization to Acquire Real Property at 369 Forest Street
(Block 210, Lot 28).

              WHEREAS, the property at 369 Forest Street is listed as an abandoned property on the Abandoned Properties List established by Chapter 17 of the Town Code, pursuant to the New Jersey Abandoned Properties Rehabilitation Act, N.J.S.A. 55:19-78 et seq., (the “Abandoned Properties Laws”); and


              WHEREAS, pursuant to the Abandoned Properties Laws the Town is authorized to acquire property by Eminent Domain; and


              WHEREAS, under New Jersey’s Eminent Domain Law, N.J.S.A. 20:3-1 et seq., the Town is first required to offer to acquire the property voluntarily before pursuing eminent domain; and


              WHEREAS, the Town offered to acquire the property at 369 Forest Street (the “Property”) for $160,000, which is the fair market value determined by the Town’s appraiser; and


              WHEREAS, the owner of the Property, HSBC Bank, NA, as Trustee, agreed to accept that offer; and


              WHEREAS, pursuant thereto, the Town wishes to enter into a contract for the purchase of 369 Forest Street; now, therefore, be it


              RESOLVED, by the Mayor and Council of the Town of Kearny, Hudson County, New Jersey that:


1.              The Mayor or the Town Administrator, and the Town Clerk are authorized to execute a Contract for the acquisition of 369 Forest Street substantially in the form attached hereto.


2.              The Mayor and Town Administrator are authorized to take all other action and to execute all other documents necessary to complete the acquisition of the Property.
